Social security garnishment

What income is protected from garnishment? Can I file suit against social security? Is social security or pension income safe from garnishment? The garnishment rate for defaulted student loans is also percent but, unlike with taxes, garnishment can’t leave you with less than $7in benefits a month.

If the IRS did not receive any response, the IRS sends a second notice, demand letter, and a filled-out tax report generated by the IRS. First, to put your mind at ease, Supplemental Security Income (SSI) cannot be garnished under any circumstance. That income is totally protected.


The only exception is if the government finds that you are not, in fact, entitled to SSI. However, if your employer received the AWG employer package, which includes the garnishment order and notice (you would have received a copy of it too), you are considered active in AWG. Once you are active in AWG, you will remain active until your debt is paid in full, unless you file for a waiver or a request for reconsideration. The final notice of intent to levy should outline your right to appeal. A Collection Due Process hearing can be requested within days of receiving that letter. You have the right to request an equivalent hearing for about a year.


For a child support garnishment , the IWO states that the child will reside with the non-custodial parent in July and August of every year.

In this situation, we will suspend garnishment of benefits for July and August of each year for the duration of the current order. Banks used to be allowed to comply with court orders for garnishment without checking the source of the income.
