In VA law, such claims frequently go by the abbreviation “TDIU ,” referring to a Total Disability rating based upon Individual Unemployability. It is a common misunderstanding that a veteran can only qualify for a TDIU rating if he meets or exceeds a certain percentage disability requirement: namely,. TDIU claims are denied all the time, often because most veterans don’t realize that it is hard to get it done right. Winning them depends on the strength of evidence you submit to the VA, and how well that evidence is presented.
To establish entitlement to a total disability rating for compensation based on individual unemployability ( TDIU ), the Veteran must be unemployable in fact (unable to secure or follow substantially gainful employment) by reason of service-connected (SC) disability and either. A VA TDIU claim is a request that the VA assign you a total rating of 1 – even if your schedule ratings are less than 1 – because your service connected condition(s) precent you from getting work. The Board may decide to send your claim back to the VARO. Generally, a BVA remanded decision will instruct the VARO on how to proceed with your TDIU claim.
