An overpayment occurs when Social Security pays you more than you should have been paid. If this happens, we will notify you. Our notice will tell you why you have been overpaid and how you can pay us back. If we grant you a waiver , you will not have to repay all or part of the overpayment.
You cannot pay back the overpayment because you need the money to meet your ordinary living expenses. You may have to submit bills to show that your monthly expenses use up all of your income and that it would be a hardship for you to repay. A Social Security representative will review your household budget and decide if the overpayment waiver can be granted.
However, you do not have to pay it all back at once. Processing the overpayment workload is pretty low on the priority list of things to do. Frankly a waiver can sit on a claims reps desk without being worked on for months and months. Depends upon how much of a backlog an office has and on.
If you want SSA to waive your overpayment , you must fill out SSA’s waiver form , “Request for Waiver of Overpayment Recovery or Change in Repayment Rate. Be thorough in your and do not leave any blanks. If you were overpaid Social Security Disability Insurance (SSDI) benefits and are currently receiving SSDI benefits, the SSA will withhold the full amount of your benefit check each month until the overpayment is paid off.
The withholding will start days after you receive the notice of overpayment. Just remember to make copies before you submit anything in case Social Security loses it, which also happens a lot. The first step is figuring out why there is an overpayment.
Here are the rules: Ask for a reconsideration of your waiver in writing at your local Social Security office. File the request within days of being turned down for a waiver. If you file your request within days, SSA will not try to recover the overpayment until after your case is reviewed. SSI recipients can ask for reconsideration of a request to waive an overpayment. To do that, contact your local Social Security office and tell the representative that you want to request reconsideration of the waiver decision.
Use the Request for Reconsideration form (SSA-561) to file your request. You may ask to see your file to see the information we used in figuring the overpayment. You may have us explain the reason for the overpayment while you are examining your file. If the total overpayment is $000. You should go to your local Social Security Office to ask someone about this. If you receive SSI, Social Security cannot take more than of your monthly benefit to pay down an overpayment. Both SSI and SSDI recipients, however, can ask for Social Security to set up an affordable repayment agreement.
A waiver may be granted only if the authorized official determines that collection of the overpayment debt would be against equity and good conscience and not in the best interests of the United States.
